Terms of use for EMMA’s ticket shop

These terms of use for the ticket shop apply to event tickets, merchandise and other services and products sold by EMMA – Espoo Museum of Modern Art (EMMA Art Museum Foundation sr.) through its ticket shop.

By placing an order in EMMA’s ticket shop, the customer accepts these terms of use.

2. Ticket shop and service providers

EMMA acts as the merchant of the ticket shop. The technical implementation of EMMA’s ticket shop is provided by Liveto Group Oy and payment processing by Paytrail Oyj. Liveto and Paytrail act as technical service providers. The agreement for the purchase of a ticket, service or product is always concluded between the customer and the merchant, i.e. EMMA.

When using the ticket shop, in addition to these terms, the terms of Liveto Group Oy and Paytrail Oyj apply insofar as they concern the technical implementation of the platform and payment service.

3. Products and prices

The content and prices of tickets, services and products sold in the ticket shop are indicated at the time of order. Prices include VAT unless otherwise stated.

The final total price of the order, including any service and handling fees, is shown to the customer before confirming the order.

We reserve the right to change prices, selection and availability.

4. Payment and payment methods

Paytrail Oyj (2122839-7) acts as the payment intermediary and payment service provider in cooperation with Finnish banks and credit institutions. Paytrail Oyj appears as the payment recipient on the bank statement or card statement and forwards the payment to the merchant. Paytrail Oyj holds a payment institution licence.

5. Event tickets and service products

5.1 Cancellation and refund policy
Tickets are generally not exchangeable or refundable. Event and admission tickets are leisure services as defined by the Consumer Protection Act and do not carry a 14-day right of withdrawal unless otherwise stated separately. This also applies where the ticket has not been used or the event has not been attended.

An unused ticket may be transferred to another person before the start of the event, unless the ticket or event information specifies that the ticket is personal. EMMA is not responsible for the resale or transfer of tickets to third parties.

5.2 Ticket delivery and re-delivery
The ticket is delivered electronically in PDF format with the order confirmation. A lost ticket can be reissued by contacting EMMA.

EMMA reserves the right to invalidate the original ticket in order to prevent misuse.

6. Merchandise

6.1 Cancellation and refund policy
In distance selling of physical products, the customer has a 14-day right of withdrawal in accordance with the Consumer Protection Act. A PDF ticket or its printed version is not considered a physical product. The withdrawal period begins when the customer has received the product. The returned product must be unused, in its original packaging and in its original condition. Returns must always be notified in advance by email: info@emmamuseum.fi

Refunds are primarily made to the payment method used in the order. If this is not technically possible for a particular payment method, it will be communicated separately in connection with the refund. Delivery or service charges are not refunded.

The product can be returned free of charge via Posti using EMMA Shop’s contract number 617504. The shipment must be carefully packaged. The return form must be filled in as instructed by Posti.

If desired, the customer may exchange the product for another equivalent product, provided that the product is unused and a corresponding product is available. Exchanges are agreed case by case with EMMA customer service.

6.2 Delivery and collection
Merchandise is generally collected in connection with an event or museum visit at the venue or another specified collection point. Any postal or other delivery method and fees are informed at the time of order.

7.Changes and event cancellation

EMMA reserves the right to changes in programme and schedule.

If an event is completely cancelled by EMMA, the ticket price will be refunded, with any service fee, handling charge and payment method surcharge deducted from the refundable amount. Fees charged by the payment service provider will be deducted to the extent that they are not recoverable from the provider and insofar as applicable legislation permits.

8. Liability and complaints

Any complaints must be addressed to EMMA without delay. Complaints must be made within a reasonable time from detecting the defect. EMMA is not liable for damages caused by force majeure, such as authority regulations, exceptional circumstances or technical failures.

9. Processing of personal data

Customer personal data is processed for ticket sales and customer relationship management in accordance with EMMA’s ticket shop customer register description. The description is available on EMMA’s website.

10. Acceptance of the terms of use

By placing an order in EMMA’s ticket shop, the customer accepts these terms of use. The use of the ticket shop is also subject to the terms of Liveto Group Oy and the payment terms of Paytrail Oyj insofar as they concern the technical implementation of those services.

11. Dispute resolution

These terms are governed by Finnish law. Any disputes shall primarily be resolved through negotiation. If necessary, the consumer may submit the matter to the Consumer Disputes Board.
